Chapter 7 Official Bankruptcy Forms

All bankruptcy courts in the United States use the same Official Bankruptcy Forms for individuals filing Chapter 7 bankruptcy. The following official forms are required in all Chapter 7 bankruptcy cases:

Voluntary Petition for Individuals Filing for Bankruptcy: The primary form initiating the bankruptcy. You must fill in your name and address and other basic information.

Schedule A/B: Property: You must fill in all of your assets, including real estate, vehicles, household items like furniture, jewelry, bank accounts, etc.

Schedule C: Exemptions: You must list which property you are claiming as “exempt” (protected) based on the exemption laws applicable to the state you live in. In most cases, everything you own is exempt.  

Schedule D: Secured Debts: You must list all of your debts that are secured by collateral, such as mortgages and vehicle loans.

Schedule E/F: Unsecured Debts: You must list all of your debts which are not secured by collateral, such as credit card debts, medical bills, utility debts, and most other types of debts.  

Schedule G: Executory Contracts and Unexpired Leases: You must provide information about any executory contracts (such as gym memberships and cell phone contracts) and unexpired leases (such as vehicle and apartment leases) you are a party to.  

Schedule H: Codebtors: You must list the names and addresses of any co-signers or co-borrowers on any of your debts.  

Schedule I: Your Income: You must list your monthly income and payroll deductions.
 
Schedule J: Your Expenses: You must list your monthly expenses.  

Summary of Your Assets and Liabilities and Certain Statistical Information: This is a summary of certain information you provide in other forms. 

Declaration About an Individual Debtor’s Schedules: You must declare on this form under penalty of perjury that the information you provide is true and correct.  

Statement of Financial Affairs for Individuals Filing for Bankruptcy: Various questions about your financial affairs.  

Statement of Intention for Individuals Filing Under Chapter 7: You must specify your intention regarding any secured debts and unexpired personal property leases. Do you want to keep your house and vehicle and continue paying for them or do you want to surrender them? 

Chapter 7 Statement of Your Current Monthly Income: You must list your and your spouse’s average monthly income over the past 6 months.  

Statement About Your Social Security Numbers: You must list your social security number.  

Application to Have the Chapter 7 Filing Fee Waived (if applicable): You must fill in information about your assets and income to show why you are unable to pay the Chapter 7 court filing fee.

Application for Individuals to Pay the Filing Fee in Installments (if applicable): You must state why you are unable to pay the court filing fee in full at the time of filing and how you are proposing to pay it within no more than 4 months.  

Creditor Matrix: You must list your creditors’ names and mailing addresses in alphabetical order.
